ARTICLE 1 - SCOPE
These General Terms and Conditions of Sale (referred to as 'T&Cs') apply, without restriction or reservation, to all sales concluded by the Seller ('Seller or Nuré Nutrition') with non-professional buyers ('Clients or the Client'), wishing to purchase the products offered for sale ('Products') by the Seller on the website www.nure-nutrition.com.
The Products offered for sale on the website include:
- Dietary supplements, food products, and e-books.
The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the nure-nutrition.com site, which the client is required to read before ordering. The selection and purchase of a Product is solely the responsibility of the Client. Product offers are valid within the limits of available stocks, as specified at the time of placing the order, or within the timeframe defined at the time of purchase.
These T&Cs are accessible at any time on the nure-nutrition.com site and will prevail over any other document. The Client declares having read these T&Cs and accepted them by checking the box provided before initiating the online ordering process on the nure-nutrition.com site. Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Client.

The Products presented on the nure-nutrition.com site are offered for sale in the following territories:
France, Europe (EU), Switzerland, UK
For orders to a country other than these, the Client is the importer of the relevant Products. For all Products shipped outside the European Union and DOM-TOM, the price will be calculated exclusive of tax automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be required. These will be the sole responsibility of the Client.

ARTICLE 2 - CONDITIONS OF THE ONLINE SHOP
By accepting these General Terms and Conditions of Sale, you declare that you are of legal age in your country of residence, or that you are of legal age in your country of residence and have provided consent for any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purposes, nor violate the laws of your jurisdiction in the use of the Service (including, but not limited to, copyright laws).
You may not resell the products purchased on our site to third parties, whether individuals or entities.
You must not transmit any viruses or any code of a destructive nature.
Violation of any of these Terms will result in an immediate termination of your use of the Service.
ARTICLE 3 - PRICES
The Products are provided at the current rates listed on the nure-nutrition.com site, at the time of the Seller's order registration.
Prices are quoted in Euros, including VAT, or in Swiss Francs, excluding VAT.
The rates consider any reductions that may be granted by the Seller on the nure-nutrition.com site.
These rates are firm and non-revisable during their validity period, but the Seller reserves the right to change prices outside the validity period at any time.
Prices do not include handling, shipping, transport, and delivery charges, which are billed in addition, under the conditions indicated on the site and calculated prior to placing the order.
The payment requested from the Client corresponds to the total purchase amount, including these fees.
An invoice is issued by the Seller and may be provided to the Client upon request.
ARTICLE 4 – ORDERS
The Client is responsible for selecting on the nure-nutrition.com website the Products they wish to order, according to the following terms:
The Client chooses one or more products, adds them to their cart, which they can delete or modify before confirming the order and accepting these terms and conditions of sale. They will then enter their details, log into their account, and select the delivery method. After confirming the information, the order will be considered final and will require payment by the Client according to the conditions set forth.
Product offers are valid as long as they are visible on the site, within available stock limits. The sale will only be considered valid after full payment of the price. It is the Client's responsibility to verify the accuracy of the order and to report any errors immediately. Any order placed on the nure-nutrition.com site constitutes the formation of a distance contract between the Client and the Seller.
The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute regarding payment for a previous order.
The Client can track the progress of their order on the site or via the confirmation email.
Any order constitutes acceptance of the prices and the description of the products available for sale. Any dispute on this point will occur as part of a possible exchange and the guarantees mentioned below.
In certain cases, notably non-payment, incorrect address, or other issues with the buyer's account, the seller reserves the right to block the buyer's order until the problem is resolved.

Electronic Signature
The online provision of the buyer’s credit card number and the final validation of the order will constitute proof of the buyer’s agreement:
the enforceability of the sums due under the order form;
express signature and acceptance of all operations carried out.
In case of fraudulent use of the credit card, the buyer is invited to contact the seller at the following email address: contact@nure-nutrition.com as soon as they become aware of such use.
Order Confirmation
The seller provides the buyer with an order confirmation by email.
Proof of Transaction
The computerized records, stored in the seller's computer systems under reasonable security conditions, will be considered proof of communications, orders, and payments made between the parties. The archiving of order forms and invoices is carried out on a reliable and durable medium that can be produced as evidence.
Product Information
The products governed by these general conditions are those listed on the seller's website and indicated as sold and shipped by the seller. They are offered subject to available stocks.
Products are described and presented with the utmost accuracy. However, if errors or omissions have occurred regarding this presentation, the seller's liability cannot be engaged.
Product photographs are not contractual.
Prices
The seller reserves the right to modify its prices at any time but undertakes to apply the rates in force indicated at the time of the order, subject to availability on that date.
Prices are indicated in euros including VAT or in Swiss francs excluding VAT.
Prices in euros take into account the VAT applicable on the day of the order, and any change in the applicable VAT rate will automatically be reflected in the price of products on the online store.
Prices in Swiss francs are exclusive of tax.
Shipping costs are not included in the product prices and will be billed additionally based on the chosen delivery method, weight, and place of delivery.
If one or more taxes or contributions, particularly environmental ones, are created or modified, upward or downward, this change may be reflected in the sale price of the products.

Payment Methods
This is an order with a payment obligation, meaning that placing the order requires payment from the buyer.
To pay for their order, the buyer has a payment method made available by the seller. The buyer guarantees the seller that they have any necessary authorizations to use the chosen payment method when validating the order form. The seller reserves the right to suspend any order processing and delivery in the event of refusal of payment authorization by a bank card organization or in the event of non-payment. The seller also reserves the right to refuse to make a delivery or honor an order from a buyer who has not fully or partially paid for a previous order or with whom a payment dispute is being administered.
Purchases are paid for using a bank payment card (Blue, Visa, Mastercard) or a Paypal account. The Client guarantees Nuré Nutrition that they are fully authorized to use the payment card for their order and that these payment methods legally provide access to sufficient funds to cover all costs resulting from their order on the website.
ARTICLE 5 – DELIVERIES
Delivery consists of the transfer of physical possession or control of the Product to the Client. Unless there are specific cases or unavailability of one or more Products, Products ordered will be delivered all at once.
The Seller agrees to make every effort to deliver the products ordered by the Client within the timeframe specified below.
If the Products ordered have not been delivered within 10 days after the estimated delivery date, for any reason other than force majeure or the Client’s own action, the sale may be canceled at the Client’s written request under the conditions provided in Articles L 216-2, L 216-3, and L241-4 of the Consumer Code. The amounts paid by the Client will then be returned to them no later than fourteen days following the contract termination date, excluding any compensation or withholding.
In the event of a specific request from the Client regarding packaging or transportation conditions for the ordered products, duly accepted in writing by the Seller, the related costs will be subject to an additional invoice, based on a quote previously accepted in writing by the Client.
The Products ordered by the Client will be delivered within mainland France or to the following areas: Europe (EU), Switzerland, UK.
Deliveries are carried out within the following time frames:
ShoptoShop (Chronopost): between 3 and 6 business days for mainland France from the date of dispatch.
Colissimo: between 2 and 5 business days for mainland France from the date of dispatch.
For orders made abroad: between 5 and 14 business days.
The dispatch and delivery times may be extended by 2 days during sales or any other promotional period. Furthermore, Nuré Nutrition informs its Clients that these delivery times do not include Sundays or public holidays.
During pre-sales, sales made before the products have been received by the seller, the delivery time is indicated on the product page, and the buyer should take note before placing their order.
Colissimo
Products ordered and delivered by Colissimo are delivered according to the terms and timing specified above.
Products are delivered to the address provided by the buyer on the order form, and the buyer must ensure its accuracy. Any parcel returned to the seller due to an incorrect or incomplete delivery address will be resent at the buyer's expense.
If a parcel is not received within the specified time, the client should send an email to contact@nure-nutrition.com, providing the order number. An inquiry will be conducted with the carrier, who must report to Nuré Nutrition.
In case of unavailability of the ordered product, the buyer will be informed as soon as possible and will have the option to cancel their order. The buyer may then choose either a refund of the amounts paid within 14 days at the latest of their payment or an exchange of the product.
Resolution of Delivery Disputes
Delivery is understood as the transfer to the consumer of physical possession or control of the goods.
Upon delivery, if the client receives a parcel that has been damaged or tampered with, they must take photos and inform Nuré Nutrition. The client can send the photos to contact@nure-nutrition.com.
In accordance with Article L133-3 of the Commercial Code, you have a maximum of 2 days from the delivery date for shipments within France to report a claim to our customer service at contact@nure-nutrition.com; otherwise, your claim will not be accepted.

If the products need to be returned to the seller, a return request must be made to the seller within 14 days following delivery. Any claim made beyond this period cannot be accepted. The return of the product will only be accepted for products in their original condition (packaging, accessories, instructions...).
Treatment of “Unclaimed” Parcels
These are parcels that were not collected by clients at the Post Office/pick-up point within the allotted time.
After receiving and accepting the parcel from the buyer by Nuré Nutrition services, a credit note (total order amount, minus shipping fees) will be credited to your bank account within 14 days following receipt by Nuré Nutrition. You may then place your order again.
ARTICLE 6 - TRANSFER OF OWNERSHIP
The transfer of ownership of the Seller's Products to the Client will only be completed after full payment of the price by the Client, regardless of the delivery date of said Products.
ARTICLE 7 - RIGHT OF WITHDRAWAL
In accordance with the provisions of the Consumer Code, the Client has a period of 14 days from the delivery date of their order to return any item that does not suit them and request an exchange or refund without penalty, except for return costs which remain the Client’s responsibility.
Returns must be made in their original condition and complete (packaging, accessories, instructions...) allowing their resale in new condition. Opened, damaged, soiled, or incomplete products are not taken back. For reasons of hygiene and safety, any opened product will not be accepted.
The Client's withdrawal request must be made online via the contact form or by email at contact@nure-nutrition.com.
If the Client exercises their right of withdrawal online, Nuré Nutrition will send an acknowledgment of receipt of the withdrawal by email.
Returned products must be in their original packaging and in new condition. Upon exercising the right of withdrawal, the price of the product(s) purchased will be refunded. Return costs are the responsibility of the Client.
The exchange (subject to availability) or refund will be processed within 7 to 14 days from receipt by the Seller of the returned products under the conditions described above.
According to Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts involving:
the supply of goods whose price depends on fluctuations in the financial market beyond the control of the professional and likely to occur during the withdrawal period;
the supply of goods made to the consumer’s specifications or clearly personalized;
the supply of goods liable to deteriorate or expire rapidly;
the supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection;
the supply of goods which, after delivery and by their nature, are inseparably mixed with other items;
the supply of alcoholic beverages whose delivery is delayed beyond thirty days and whose value agreed upon at the conclusion of the contract depends on fluctuations in the market beyond the professional’s control;
maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by them, limited to spare parts and work strictly necessary to respond to the emergency;
the supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery;
the supply of a newspaper, periodical, or magazine, except for subscription contracts to such publications;
the supply of digital content not provided on a tangible medium, the execution of which has begun after the consumer's prior express consent and express waiver of their right of withdrawal.
ARTICLE 8 – FORCE MAJEURE
All circumstances beyond the control of the parties that prevent the execution under normal conditions of their obligations are considered causes for exoneration of the parties' obligations and result in their suspension.
The party invoking the circumstances referred to above must immediately notify the other party of their occurrence, as well as of their disappearance.
Cases of force majeure are understood to mean events that are irresistible, external to the parties, unpredictable, inevitable, beyond the control of the parties, and which cannot be prevented by them, despite all reasonable efforts.
Expressly, the following are considered cases of force majeure or unforeseeable circumstances, in addition to those usually recognized by the case law of French courts and tribunals: blockage of transportation or supply channels, earthquakes, fires, storms, floods, lightning strikes, shutdown of telecommunication networks, or difficulties specific to external telecommunication networks affecting clients.
The parties will come together to assess the impact of the event and agree on the conditions under which the contract’s execution will continue. If the force majeure event lasts longer than three months, the present general conditions may be terminated by the affected party.
ARTICLE 9 - INTELLECTUAL PROPERTY
Nuré Nutrition is a registered trademark with the National Institute of Industrial Property (INPI) and is protected as such.
The content of the website remains the property of the Seller, the sole holder of intellectual property rights on this content. It is strictly reserved under copyright and intellectual property law worldwide.
Buyers agree not to make any use of this content. Any total or partial reproduction of this content is strictly prohibited and may constitute a copyright infringement liable to civil and criminal prosecution.
ARTICLE 10 – DATA PROTECTION
The Client is informed and accepts that the personal data they provide on the Site may be collected and used by Nuré Nutrition.
Nuré Nutrition collects personal data from the Client, such as:
- Name, First Name
- Email address
- Phone number
- Delivery and billing address
- IP address
- Logs, in compliance with legal provisions.
The data collected is used by the Seller and its co-contractors for contract execution and to ensure the effectiveness of sales and delivery of the Products.
These data are retained for 5 years to cover the prescription period for civil contractual liability.
Nuré Nutrition reserves the right to seek damages in the event of an infringement of its intellectual property rights.
ARTICLE 11 – DISPUTES
For any complaints, please contact customer service at the address or email of the Seller listed in ARTICLE 1 of these T&Cs.
The Client is informed that they may, in any case, resort to conventional mediation or any alternative dispute resolution mode (conciliation, for example) in the event of a dispute.
All disputes arising from purchase and sale transactions concluded under these T&Cs that are not resolved amicably between the Seller and the Client or through mediation will be submitted to the competent courts under the conditions of common law.
