ARTICLE 2 - ONLINE STORE TERMS

By accepting these General Terms and Conditions of Sale, you declare that you are at least the age of majority in your country of residence, or that you are of legal age in your country of residence and have given us your consent to allow any of your minor dependants to use this website.

You may not use our products for any illegal or unauthorised purpose, nor may you, in your use of the Service, violate any laws in your jurisdiction (including, but not limited to, copyright laws).

You may not resell products purchased on our website to third parties, whether individuals or legal entities.

You must not transmit viruses or any code of a destructive nature.

A breach of any of the Terms will result in the immediate termination of your use of the Service.

    ARTICLE 3 - PRICES

The Products are supplied at the prices in force displayed on the nure-nutrition.com website at the time the order is registered by the Seller.

Prices are expressed in euros, including VAT, or Swiss francs excluding tax.

The prices take into account any discounts that may be granted by the Seller on the nure-nutrition.com website.

These prices are firm and non-revisable during their period of validity, but the Seller reserves the right to modify prices at any time outside their period of validity.

Prices do not include processing, shipping, transport and delivery costs, which are charged in addition under the conditions indicated on the website and calculated before the order is placed.

The amount payable by the Customer corresponds to the total purchase amount, including these costs.

An invoice is issued by the Seller and may be provided to the Customer upon request.

    ARTICLE 4 – ORDERS

It is the Customer’s responsibility to select the Products they wish to order on the nure-nutrition.com website according to the following procedure:

The Customer selects one or more products and adds them to their basket. The Product(s) may be removed or modified before the Customer confirms the order and accepts these General Terms and Conditions of Sale. The Customer will then enter their contact details, log in to their account and select a delivery method. Once the information has been confirmed, the order will be considered final and payment will be required from the Customer in accordance with the applicable terms.

Product offers are valid for as long as they are visible on the website, subject to availability. The sale shall only be considered valid after full payment of the price. It is the Customer’s responsibility to verify the accuracy of the order and immediately report any errors. Any order placed on the nure-nutrition.com website constitutes the formation of a distance contract between the Customer and the Seller.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning payment for a previous order.

The Customer may track the progress of their order on the website or via the confirmation email.

Any order constitutes acceptance of the prices and descriptions of the products available for sale. Any dispute relating to these matters shall be handled within the framework of any applicable exchange and warranty provisions set out below.

In certain cases, including non-payment, an incorrect address or another issue relating to the purchaser’s account, the Seller reserves the right to block the purchaser’s order until the issue has been resolved.

For any questions regarding order tracking, the purchaser may email the Seller at the following email address: contact@nure-nutrition.com

    Electronic signature

Providing the purchaser’s bank card number online and final confirmation of the order shall constitute proof of the purchaser’s agreement:

    • enforceability of the amounts due under the order;

    • express signature and acceptance of all transactions carried out.

In the event of fraudulent use of the bank card, the purchaser is invited, as soon as such use is identified, to contact the Seller at the following email address: contact@nure-nutrition.com

    Order confirmation

The Seller provides the purchaser with an order confirmation by email.

    Proof of transaction

Computerised records stored in the Seller’s computer systems under reasonable security conditions shall be considered proof of communications, orders and payments made between the parties. Purchase orders and invoices are archived on a reliable and durable medium that may be produced as evidence.

    Product information

The products governed by these General Terms and Conditions are those displayed on the Seller’s website and identified as being sold and shipped by the Seller. They are offered subject to availability.

The products are described and presented as accurately as possible. However, the Seller shall not be held liable for any errors or omissions that may occur in such presentation.

Product photographs are not contractually binding.

    Prices

The Seller reserves the right to change its prices at any time but undertakes to apply the prices in force at the time the order is placed, subject to availability at that time.

Prices are indicated in euros including VAT or in Swiss francs excluding tax.

Prices in euros include the VAT applicable on the date of the order, and any change to the applicable VAT rate will automatically be reflected in the price of products in the online store.

Delivery costs are not included in the price of the products and will be charged in addition depending on the delivery method selected, the weight and the delivery destination.

If one or more taxes or contributions, particularly environmental taxes, are introduced or modified, whether increased or decreased, such changes may be reflected in the selling price of the products.

    Payment methods

This is an order with an obligation to pay, meaning that placing an order requires payment by the purchaser.

To pay for their order, the purchaser has access to a payment method made available by the Seller. The purchaser guarantees to the Seller that they have any authorisations necessary to use the chosen payment method when confirming the order. The Seller reserves the right to suspend order processing and delivery if authorisation for payment by bank card is refused by officially accredited organisations or in the event of non-payment. In particular, the Seller reserves the right to refuse delivery or fulfilment of an order placed by a purchaser who has not paid in full or in part for a previous order or with whom a payment dispute is currently ongoing.

Purchases may be paid for using a bank payment card (Carte Bleue, Visa, Mastercard) or a PayPal account. The Customer guarantees to Nuré Nutrition that they are fully authorised to use the payment card to pay for their order and that these payment methods legally provide access to sufficient funds to cover all costs resulting from their order on the Website.

    ARTICLE 5 – DELIVERIES

    Delivery terms

Delivery means the transfer to the Customer of physical possession or control of the Product. Unless there are special circumstances or one or more Products are unavailable, the Products ordered are delivered together in a single shipment.

The Seller undertakes to use its best efforts to deliver the Products within the indicative timeframes specified when the order is placed. Deliveries are made in mainland France as well as Europe (EU), Switzerland and the United Kingdom.

Estimated delivery times are as follows: 2 to 5 business days for Colissimo in mainland France, 3 to 6 business days for Shop2Shop (Chronopost), and between 5 and 14 business days for international orders, from the date of shipment. These timeframes may be extended by 5 days during sales or promotional periods and do not include Sundays and public holidays.

In the case of a pre-order, the specific delivery timeframe is indicated on the product page and must be accepted by the purchaser before the order is confirmed.

Products are delivered to the address provided by the purchaser, who is solely responsible for its accuracy; any parcel returned due to an incorrect or incomplete address will be reshipped at the purchaser’s expense. If the parcel is made available at a collection point or post office and is not collected within the specified timeframe, it will be returned to the Seller and the shipping and order preparation costs will remain payable by the purchaser.

If the order is not received within the indicative timeframe, the Customer must contact customer service at contact@nure-nutrition.com, specifying the order number; a claim will then be opened with the carrier so that the necessary checks can be carried out.

If the Products have not been delivered within 10 days after the indicative delivery date, for any reason other than force majeure or an act or omission of the Customer, the sale may be terminated at the Customer’s written request in accordance with Articles L216-2, L216-3 and L241-4 of the French Consumer Code; any amounts paid will then be refunded within a maximum period of fourteen days, excluding any additional compensation.

If the Customer makes a special request concerning packaging or transport conditions that is duly accepted in writing by the Seller, the corresponding costs will be subject to an additional charge based on a quotation accepted in advance.

Finally, if a Product becomes unavailable after an order has been placed, the Customer will be informed as soon as possible and may choose between a refund of the amounts paid within fourteen days or an exchange of the Product.

    Resolution of delivery disputes

Delivery means the transfer to the consumer of physical possession or control of the goods.

Upon delivery, if the Customer receives a parcel that has suffered damage or loss, they must take photographs and inform Nuré Nutrition. The Customer may send the photographs to contact@nure-nutrition.com

In accordance with Article L133-3 of the French Commercial Code, you have a maximum of 2 days from the delivery date to report a claim to our customer service team at contact@nure-nutrition.com, failing which your claim may not be taken into account.

    Photographs to be taken:

    Photographs of the damaged goods

Photographs of the inside of the parcel showing the internal protective materials and how the goods were secured

Photographs of the outer packaging with the shipping label visible.

ARTICLE 6 - TRANSFER OF OWNERSHIP

Ownership of the Products shall only be transferred from the Seller to the Customer after full payment of the price by the Customer, regardless of the delivery date of the Products.

ARTICLE 7 - RIGHT OF WITHDRAWAL

Delivery means the transfer to the consumer of physical possession or control of the goods.

Application of the right of withdrawal

In accordance with the provisions of the French Consumer Code, the purchaser has a period of 14 days from the delivery date of their order to return any item that is unsuitable and request an exchange or refund without penalty, with the exception of return shipping costs, which remain payable by the purchaser.

Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.), allowing them to be resold as new. Products that have been opened, damaged, soiled or are incomplete will not be accepted. For hygiene and safety reasons, any opened product will not be accepted for return.

The Customer’s request to exercise the right of withdrawal must be made by email to contact@nure-nutrition.com

If the right of withdrawal is exercised within the above-mentioned period, the price of the purchased product(s) will be refunded. Return shipping costs are payable by the purchaser.

The exchange (subject to availability) or refund will be processed within 7 days and, at the latest, within 14 days from the Seller’s receipt of the products returned by the purchaser in accordance with the conditions set out above.

    ARTICLE 8 – FORCE MAJEURE

Any circumstances beyond the control of the parties that prevent the normal performance of their obligations shall be considered grounds for exemption from such obligations and shall result in their suspension.

The party invoking the circumstances referred to above must immediately notify the other party of their occurrence and of their cessation.

All events or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, beyond the parties’ control and that cannot be prevented despite all reasonable efforts shall be considered force majeure events.

In particular, in addition to those usually recognised by French courts and tribunals, the following are expressly considered force majeure events or unforeseen circumstances: disruption of transport or supply networks, earthquakes, fires, storms, floods, lightning, shutdown of telecommunications networks or difficulties affecting telecommunications networks external to Customers.

The parties shall consult each other to assess the impact of the event and agree on the conditions under which performance of the contract will continue. If the force majeure event lasts for more than three months, these General Terms and Conditions may be terminated by the affected party.
